Update: Judge Rules the Constipated Convict Has to Go it on his Own

Terry Nichols has to go on his own
Terry Nichols, most recently known as the “Constipated Convict,” (see FriendsEat.com Famous Convict is Constipated – Wants to Sue Prison over Food Choices) and former co-conspirator in the 1995 bombing of the Oklahoma City Alfred P. Murrah Federal building, had his day in court last week, where he petitioned to be assigned an attorney to help him develop his lawsuit against the Supermax prison where he’s spending the rest of his days.
Nichols has been trying to pursue a lawsuit against the Florence, Colorado prison because he’s unhappy with the quality of the meals being served. He claims that the lack of whole grains and fresh food in his diet is causing him to “sin against God,” and that it is a violation of the eighth amendment, cruel and unusual punishment. He further asserts that the food doesn’t contain enough fiber and has been giving him gas, constipation and hemorrhoids, and prevents him from having soft, comfortable bowel movements. To strengthen his case, he enlisted the help of prison pal and fellow inmate, Eric Robert Rudolph, the abortion clinic bomber.
NewsOK.com reports the results of Nichols’ hearing. “Contrary to Mr. Nichols’ characterization, the issues in the case are not particularly complex,” wrote Magistrate Judge Craig B. Shaffer, in rendering his decision. “Mr. Nichols has thus far adequately presented his claims unaided by counsel. Mr. Nichols’ concerns about conflicting testimony and evidence, cross-examination of witnesses and ‘expert witnesses’ are premature.”
The bottom line: Should Nichols decide to pursue his lawsuit against the prison, he will have to go it alone.
